day four of the b.a.r.t. strike hitting the morning commute hard. and labor talks with moving just as slow as the traffic. the latest move to get a deal

done. >> reporter: we're live in fremont. this is just one of nine locations in the east bay where you can catch a free bus to the city. we'll show you what it looks like. you just have an hour left. and if you're taking your car to work today, traffic is already backing up around the bay. the spots you will want to avoid this morning. "mornings on 2" starts now. good morning. this is a live look at the bay bridge toll plaza where the commuting chaos is in full force, thanks to the continuing b.a.r.t. strike. from fremont to walnut creek and alameda, we have crews around the bay area right now monitoring all of the ways you can get to work this morning and all of the stories involved in this. good morning. welcome to "mornings on 2." i'm tori campbell. welcome back. >> welcome back to you, too. >> thank you. >> good morning.

i'm dave clark. let's check weather and traffic. steve's right over there. we have a lot of fog. the base is around 200 to 700. it's very slow. some of it is very thick t will play into a cooler forecast by the coast. parts of the bay, inland if you have the fog, it will burn off sooner. 70s, 80s. there's a ton of fog out there for this time of year. last week it was 70s, 80s by the coast. it won't be the case this week. temperatures in the 80s for some. there will be a low approaching the coast on friday. but i think it will spin in hue clouds and that's about it. fog or sun by noon. fog or soon, either cool, mild warm. 40s, 50s. inland temperatures going down. santa rosa, 46. san jose overcast and 593 -- and 53. high pressure is here. it looks like it's not going anywhere any time soon.

our pattern is on hold, if you will. fog or sun. cool for some if you have the fog, it will be warm inland. temperatures in the upper 70s or 80s. by the beaches, 50s and 60s. here's sal. steve, we have more people on the road today. we kind of knew this would happen. highway 24 is slow from walnut creek right from the 680 interchange backing up onto 680 itself. and it slows this way moving barely all the way through the tunnel and down to the other side in oakland. 580 is quickly backing up. it's not quite backed up to lakeshore, but it will be if this continues. bay bridge is backed up as well. we've had a couple of minor crashes along the way. but nothing major. this is a lot of people trying to get into the city. i want to show it to you on road sensors. you can see the red over the east bay. happily, some of the traffic on other parts of the bay commute are not as affected.

if a b.a.r.t. train runs near your freeway, that's where the slow traffic tends to be. look at 580. a lot of people use the dub rin -- dub line line there. the farther south we go, kind of out of b.a.r.t.'s reach, you will see traffic not as bad. northbound 280 is slow. so is 101. but the south bay commute looks like a normal commute. some would be b.a.r.t. riders taking advantage of free charter buses providing transit into san francisco. and janine de la vega is live in fremont to take us through what commuters need to know. ia nene -- janine? >> reporter: sal, thank you. buses have come through here eight times to pick up people. i want you to look at this live. as far as how many people are standing in line, i would guess about 100. it seems to go down a block. that's because these people are all waiting for a charter bus to return back from san francisco to pick them up. we were told on friday, the busiest time was 7:00 a.m., this morning there seems to

have been a rush at 6:00 a.m. it has not really stopped. buses started to leave at 5:00 a.m. the first people started showing up at 4:10 a.m. commuters can catch free rides at san francisco, west oakland, walnut creek, concord, dublin, pleasanton, hayward, san leandro and el cerrito. each location has five to 15 buses being used. this morning the buses will travel directly to the city. many commuters got up an hour to an hour and a half early, to ensure they would get a seat. a lot of the people used the free buses. >> the shuttle is a nice service but it's unreliable. the timings are inconvenient. if you get to the city after 8:00, i think it's impossible. >> reporter: riders are being given a round-trip ticket. riders can start to board at 3:00 a.m. they will run until 7:00 p.m.

most will make a stop in west oakland. the loading zone will be near the san francisco transbay terminal on howard between fremont and beale. we're told there are two more buses coming. you have until 8:00 a.m. to catch it. if the two buses fill up quickly, they will leave before 8:00 a.m. if you still need to catch a bus at this location, come as soon as you can. janine de la vega, ktvu channel 2 news. >> thank you, janine. we'll check back with you for an update. commuters have other options other than just lining up for the b.a.r.t. charter buses. the san francisco bay ferry is offering additional services during the strike. would-be b.a.r.t. riders have the options of a.c. transit, samtrans and caltrains. for those looking to drive, there's always casual carpooling. the b.a.r.t. strike, it goes on this morning. the commute is heavy and a mess around the bay area.

commuters are searching for alex savidge is live with more. >> reporter: burt's board of director -- burt's board of direct ears has scheduled a meeting this -- directors has scheduled a meeting this afternoon. it's closed to the public. you can see picket lines remain up near at the lake merritt b.a.r.t. station in oakland and across the system as we head into day four with the b.a.r.t. strikes with no new talks scheduled. late last night, the unions made a counteroffer. seiu and atu said this would relate to change of work rules related to new technology. that was a sticking point that caused negotiations to break down. the union are willing to accept a 12% raise but will not budge

on issues of safety. b.a.r.t. has not ibed a response to the -- issued a response to the latest counteroffer. i reached out to the a spokesperson -- out to a spokesperson but i've not heard back. how long do you think you will be out here, david? >> i hope everybody get back to work -- back to the work force and i sure hope it end as soon as possible. i'm sure that nobody wants to be here today or any other day from now on. >> reporter: meantime, out here at the lake merritt b.a.r.t. station, union members have lit candles and put up signs honoring two killed by an out of service train this weekend. striking workers hope this weekend's deadly accident will push both sides to come to an agreement. b.a.r.t. managers are willing to reach b.a.r.t. negotiations. they've been in touch with the

unions. but as far as we know there are no plans to return to the bargaining table. alex savidge, ktvu channel 2 news. new information about a deadly b.a.r.t. accident in walnut creek where two b.a.r.t. workers were killed saturday. the san francisco chronicle reports the accident happened while b.a.r.t. was training workers to run the trains in the event of a long strike. b.a.r.t. officials say the train was on a routine maintenance run. it was returning to concord after hauling cars defaced with graffiti to richmond. the ntsb is looking into whether the strike played a role in the accident. >> we have downloaded and secured the data but have not had the opportunity to review the data. we're at the very start of the investigation. the accidents occur in an instant but take a great deal of time to investigate.

weeks. he added he heard things are going well with his treatment. he's being treated for a reported substance abuse problem following his second dui arrest a month ago. once out of rehab, he's expected to turn himself into authorities in relation to gun charges. the bay area had an earthquake during the night. it was a magnitude 3. it rattled contra costa county. now, this one hit after 1:30 this morning. it was center two miles south of -- centered two miles south of danville near blackhawk. no reports of damage. some homeowners may be at risk because of some maps. only 23 earthquake maps have been drawn since 1991. despite an effort launched in the '70s to study the state's fault lines, no maps were created between 2004 and 2011 because of budget cuts. now, the lack of having those maps could lead to a public

safety risk. the l.a. times says a ban on new construction is only on faults that have been mapped. as this b.a.r.t. strike goes on an emotional plea from a woman. >> we're on this planet together. can't we get along, communicate? >> her connection to another b.a.r.t. tragedy. and really awkward timing. the latest revelations of surveillance by the nsa. it's angered some of america's closest allies. where 70 million phone records were collected in one month. it's worse today than friday on the roads. you will see a lot of slow traffic long lines of buses and ferries you will try to get you through it coming up. a lot of fog. inland temperatures continue to be above average. by the coast, they are cooler. we'll have the forecasted temperatures coming up. the great american novel.

continuing coverage of the b.a.r.t. strike now in its fourth day. these are live pictures of the alameda ferry terminal where there have been some lines of people waiting to get on board as an alternative to b.a.r.t. the important takeaway for this morning. sal's been saying this morning's commute is worse than fridays. there are more people on the roads. people have more options to work from home on fridays. the traffic has been snarled in the bay area. it's left commuters scrambling to find ways to get to work. b.a.r.t.'s board of directors will hold a meeting to discuss the status of negotiations. it is a closed meeting. caltrans is expecting carpool hours. some h.o.v.

lanes will stay open all day from 5:00 a.m. to 7:00 p.m. they includele 80 from the carquinez bridge to the bay bridge, 880 between san jose and the bay bridge and 680 between the benicia-martinez bridge and 580. that also applies to highway 92 in hayward. highway 84 in fremont and major toll plazas except for the golden gate bridge. you will also see a lot more chp officers on patrol. happening today -- a public hearing being held over a possible a.c. transit strike. now, management and labor leaders will go before a panel appointed by governor brown. that panel later this week has to recommend to the governor whether he should ask for a cooling-off period. some of the ac union members have twice rejected deals. the hearing is at oakland state's office building on clay sta street. it started in just about two hours. right now, truck drivers are protesting at the port of

oakland. last night we talked to one of the protest organizers who said truck drivers are angry with about what they call -- about what they call unsafe working conditions and unfair working practices. he says they will not block the port entrances because of a temporary restraining order. longshoremen are being asked to take part in this protest. new details on the scope of the national security agency surveillance activities. this time in france. today, the french government summoned the u.s. ambassador about a report about tracking reports in a 30-day period. this comes from documents leaked by edward snowden. and a german newspaper is reporting that the nsa also spied on former mexican felipe calderon. according to the newspaper, in may 2010, the nsa was able to

hack into an e-mail server used by the mexican government and gain access to the mexican president's e-mail account as well as the cabinet members. edward snowden is source of this information as well, reportedly. the affordable care act website has had problems since earlier this month. republicans are still blasting the new healthcare law and the problems with the website. >> the inability of the federal government to set up a website where people can buy healthcare does not bode well because the law has yet to be rolled out. >> some want kathleen sebelius to resign because of all of the problems with the website. homeless people in the city of albany may soon have a place to live. the city council meets tonight

to talk about the homeless population in the city's bulb area. now, earlier this month, the city announced plans to remove these makeshift camping spots and turn the space into a park. well, the city's working with the berkeley food and housing project to help get housing for the 60 people who are currently living out there. 7:18. as i just said, i think the big headline people need to be aware of is the commute is worse today than it was on friday. and sal, maybe people thought it wasn't so bad. they are just trying to hit the road. you hit it on the head earlier. i think friday people have more flexibility. i think sometimes on monday they don't. some people work four tens. that kind of thing. we know for sure, it's not good getting up to the tunnel. it's worse than friday and on this particular commute and on many from walnut creek all the way up to the tunnel.

and then 680 is slow as well. i will show you that in a moment. i want to show you the toll plaza. it's still moving through. there are no problems. you did still see it's -- you can still see it's moving through. it's a lot more cars. just more for the bridge and frankly more than the bridge can handle at this time. now, i can show you 68 on on the road sensors. it's backed up to concord and 680 continues to slow into danville and san ramon. but it gets better as you drive down closer to pleasanton. 580 is slow out of livermore. a lot of people on this commute would be on b.a.r.t. trains. so from livermore to dublin. it's solid. when you go to hayward, 238 is slow to union city. let's go to steve. forecast, easy. fog, coast and bay. some of it very thick. 50s, 60s on the high side. 70s and 80s with a lot of sunshine inland. time to put your thinking caps on. i have a lot of information

here. as you know there's not been any rain in san francisco. so far this month, zero. average is just over an inch of rain. the last october with no rain in san francisco, 33 years ago, 1980. so does a dry october equal a dry year? the driest year was 1850 when 7.24 fell. the wettest year was 1861. 49.27. we've had 15 dry octobers in san francisco. two wetter, two average, nine drier. let's put our money and go with the wetter. two dry years in a row would be awful. there is a little low out here that gave us hints it would give us rain. we'll see. it wouldn't be until friday. 43 in walnut creek. 49 sfo. low clouds and fog.

there might be a mist or drizzle but it will head back to the coast. it will start off cool and end up mild to warm. 70s and 80s inland. 50s and 60s closer to the coast and bay. we had almost 80s for everybody. this is almost like a mini time pattern -- mini summertime pattern. the low will approach and maybe give us some high clouds. i hope it gives us some rain. but right now, it doesn't look like it. watch out for big waves along the coast. the national weather service is warning. big waves are expected between sonoma and monterey counties today and tomorrow. the weather service also warns of strong rip currents and those sneaker waves. the ones that can sneak up on you and pull you out to sea. >> very scary. breaking news from las vegas, where three people have been shot inside a casino. the new details we learned just

good morning. we're entering day four of the b.a.r.t. strike. this is the first full workweek since the b.a.r.t. strike began. it's the worst day so far. traffic started to back up very early. these are live pictures of 80 in emeryville heading south, heading toward the bay bridge. you can just see a stream of

head lite -- headlights as far as the eye can see. a touch morning commute. sal will be back with more on the commute. chris christie announced he's dropping his appeal to try to block same-sex marriages. that means those marriages that started happening at midnight, they are gonna remain legal in new jersey. the governor's office submitted a formal withdrawal to the state supreme court this morning. just last week, the new jersey supreme court turned down the governor's attempts to block the same-sex marriages. on saturday, jersey city opened up the clerk's tofs for three hours so that some of the couples could start filling out the paperwork. >> we always said we would get married in the state that we live. this is exciting for us. we live in jersey city. >> there is a 72-hour waiting period for new licenses. but couples married in other states don't have to wait. same-sex marriage is now legal

7:29. welcome back to "mornings on 2." we're in day four of the b.a.r.t. strike. and take a look. there's a long line at the alameda ferry of very patient commuters waiting to take a ferry across the basins there are no -- across the bay since there are no trains running. let's check weather and traffic. is fog still a problem, steve. big-time. temperatures will be with this thick fog -- when it's below the towers, it's pretty slow. 200, to 700. some of it has made it inland. it doesn't look like since

going anywhere. fog, sun. last week we had an offshore breeze. the coast was sunny, warm to hot. that's not the case this week. 50s, 60s by the coast. 7080s -- 70s, 80s. some are cold, some are stuck because of the low cloud deck. mostly cloudy, including san francisco. this week in the low 70s. there are a few breaks in the fog but not a lot. fog, sun. cooler if you are by the water's edge. no problem getting to 80. for others they will struggle to get out of the upper 60s to 70s. here's sal. it's very slow approaching the bay bridge. some people are using the san mateo bridge instead of the bay bridge. that's a pretty good idea, i would say, although it's still very crowded. ill would say it's the best way to do it.

but you will be waiting in a lot of slow traffic. let's move along to the eastshore freeway. you can see traffic on 80. it's backed up to pinole. 24 is backed up to walnut creek. most of it is a solid long line of traffic into oakland and then the 580 interchange. i do want to mention that northbound 280 in san jose is gonna be slow, so the south bay commute, people are still on the road. i can show you the graphic where the red is in the south bay because of the slow traffic on 85 and 280. even though this is kind of a more normal commute. we certainly do have slow traffic. but the b.a.r.t. strike is the big story. bay area ferries are seeing a huge increase in the number of passengers during this strike. ktvu's brian flores is at the berry terminal. how are the roads there this morning? >> reporter: yeah, the line is getting long here. i want to show you exactly what -- not only do the commuters have to go through but the

ferry drivers as well. we're taking a look at the cargo ship. i just got one speaking with the officials and they say this is one of the harder things to deal with, especially with boert boats in the water and -- with more boats in the water and trying to maneuver around. long lines at the alameda bay ferry terminal. but the good news, the lines move quickly. the boats leave every 45 minutes or so. from what we understand, the boats are leaving about ten minutes behind right now in some east bay locations. no question, sf bay ferry bomb a popular -- has become a popular alternative. 1900 passengers on saturday. that's double when they see. last friday, they carried 7,000 passengers and that's also what they see on a friday -- that's also double what they see on a

friday. people don't have the flexibility to change their schedule as they would on a friday. and sf bay ferry knows it. >> if today turns out to be as heavy as it was in july, we expect to carry about 19,000 to 20,000 riders today compared to the normal 6,000. we're heaped to do that. if we have to carry a few more people, we appreciate their patience but we'll get to them as soon as we can. >> reporter: sf bay ferry says they have two boats. they have maintenance schedules built for the burt strike. the reason there are not as many boats on the weekend is so engineers can examine the boats. they are running on overtime. many say it's the afternoon rougher than the morning commute. ,f bay -- sf bay ferry says if you can leave earlier, 4:00,

4:30, that's better because the boats fill up. the parking lot at the alameda terminal is full. many other parking lots at the other terminals are also full. the early you can get to the terminal, the better. brian flores, ktvu channel 2 news. 7:34. we don't have the b.a.r.t. buses and trains because of the strike, but one alternative, charter buses. b.a.r.t. is providing charter buses to get people into san francisco. the charters are available during peak commute hours. pickup in the east bay is between 5:00 a.m. and 8:00 a.m. from el cerrito del norte, west oakland, concord, walnut creek, la fayette, dublin, partly sunny on, san leandro, hayward -- pleasanton, valley, hayward and fremont. the buses will return back to the east bay between 3:00 p.m.

and 7:00 p.m. now, commuters do have other options, too. the san francisco bay ferry, as you heard brian, well, the san francisco bay ferry is offering extra services during the strike. you have the option of a.c. transit, for now, at least, some transand -- samtrans and caltrains. if you want to drive, there's also casual carpooling as well. the ntsb will be back out today at the walnut creek b.a.r.t. stration to investigate the train accident on saturday that killed two workers. ktvu's tara moriarty is live in walnut creek with what some b.a.r.t. employees are saying about the possible cause of this crash. good morning, tara. >> reporter: good morning. they are chalking it up to poor communication. did the train operator not see the workers on the track. did the workers on the track not seeing the train coming? these are questions that the ntsb is gonna have to answer. there's a memorial here, flowers, cards, candles for the

two workers struck and killed by a train. crews were out here cleaning up from 2:00 to 6:00. the evidence stretched over a third of a mile on the tracks here. dozens of people had gathered nearby last night at the walnut creek b.a.r.t. station. the two workers were struck and killed by a four-car nonrevenue train while doing a track inspection. one worker was inspecting. the other was supposed to be on the lookout. radio transmissions suggest confusion about whether work was going on along the track. >> it's with great sads in that we're here -- sadness that we're here. my condolences to the families and the children. >> they are b.a.r.t. family. we're a little dysfunctional right now. but still we're family. >> reporter: according to the san francisco chronicle, b.a.r.t. was training people on the train on how to operate and have the skills in the event of

an extended strike. the ntsb arrived early yesterday to examine tracks and begin its investigation. investigators are gonna be looking at factors such as signal systems, mechanical issues and human-- human error. the ntsb will be on the scene for up to ten days. the ntsb will provide an update on the investigation at 4:00 this afternoon. we're live in walnut creek, tara moriarty, ktvu channel 2 news. >> thank you. 7:38. the widow of a b.a.r.t. worker killed by a strain five years ago -- train five years ago says she hopes the weekend tragedy makes everyone come together. >> we're on this planet together. can't we get along and communicate. just to hear that they are fighting over it, what's going on? >> lynn za strickland wears her -- lynn -- lynn za strickland wears her husband's wedding

minutes ago at an after-hours nightclub. two other shooting victims were rushed to a nearby hospital. we don't know their conditions. police say they have a suspect in custody. so far at this point, we don't know what led up to the shooting again. this is bally's casino in las vegas. at least three people shot. one person is dead. police are still out there investigating. we'll keep you posted. san jose firefighter -- san jose firefighters have controlled a fire that started at a victorian home there. it started at 3:30 a.m. on south third between 280 and east virginia street t appears it may have been an electrical fire in a vacant house. the investigation goes on. no reports of any injuries so far. san francisco police are searching for whoever shot and killed a man in the mission district. this happened about 2:20 yesterday morning near mission and 16th street. police says the man was shot in the back. he was rushed to san francisco general hospital. but he later died from his

injuries. no word yet on the man's name or who may have carried out the shooting. 7:40. a proposal for tighter regulations on gun dealers is scheduled to go before the pleasant hill city council, under the ordinance, gun deemers will need a -- dealers will need a police permit renewed each year. dealers will have to install an alarm system and surveillance cameras and employees would have to undergo background checks. there would be strict rules where the gun stores can be located. the meeting is at 7:30 tonight at city hall. the puc will hold a hearing about a controversial natural pipeline that runs right through san carlos. a judge ordered pg&e to reduce mesh pressure in -- pressure in line number 147 after a pg&e e- mail raised questions about a san bruno like situation. last week, the decision to have the lines put back into -- the

decision was made to have the lines put back into service, saying everything tested okay. how you can use this ongoing b.a.r.t. strike to put extra money in your pocket. reports of problems with facebook this morning. more on the error message when they try to post comments or just like something. right now, traffic is very, very slow at the toll plaza. this is having a big effect on many bay area freeways trying to get to the region. last week, it was clear skies. there was no fog. inland temperatures will continue to be warm. also what dry october means for san francisco. really special.

trouble logging in, posting and in the last 15 minutes, some users reported that their service appears to be come bagging. we heard about the problem and tried it ourselves. there appears to be the issue of first, some users being unable to log in. after entering their user information, they get the screen that tells them that facebook will be back soon. it warns users it's down to required maintenance. it should be able to get -- they should be able to get logged in within the next few minutes. the second issue is for users already logged in, when they upstate their state tis, they get an error message. it advises users to try again in a few minutes. we've reached out to the menlo park-based company to see what issue is, if they have any expectation of it being fixed. we have yet to hear back. some users are able to post their status updates and the

free rides at b.a.r.t. stations at eight other locations. many of the commuters got up an hour to an hour and a half early. in fremont, there was a big rush at 7:00 a.m., and riders were told there were no more buses left but to stand by. >> it's hard for us. i mean, we have to go to work and i don't know -- i'm not able to make it today. i'm not. >> reporter: what are you gonna do? go home or try to take your own car? >> yeah. i try to find out some other ways if i don't get bus ride. but i -- i know traffic will be hectic. >> reporter: another charter bus was secured at that time and that gentleman was able to get on the bus. those who made it on are we -- are being given a round-trip ticket. buses will run until 7:00 p.m. for had the commute. most will -- for the commute. most will make a stop in

a public hearing about a possible a.c. transit strike. management and leaders will make a presentation to a panel appointed by governor brown. the panel has to recommend to the governor whether he should call for a cooling off period. the hearing starts in under an hour and is on clay street. right now, workers are protesting at the port of oakland. last night we talked to one of the protest organizers. he said the truck drivers will not block the port entrances because there's a temporary restraining order. they want longshoremen to take part in this protest with them. it started at 5:00 a.m.

insurance to keep that money even after they received their federal paychecks. it's not clear if california's furloughed fell workers will be told to pay back their unemployment benefits. tomorrow, the federal government will release its september jobless reports even though it's now october. the report was actually due 18 days ago. but it could not be released because of the government shutdown. commits expect the lane -- commits expect the lab -- economists expect more jobs to be announced and they expect the unemployment to remain at 7.4%. a child hurt yesterday in a traffic accident that happened on gilman, that child was taken to san francisco general hospital with several injuries. we don't know the child's condition. we're not sure what caused the accident. police are looking for any information. if you have any information about the cause, give them a call. today is the last day to register to vote for the

upcoming november 5th election. the offyear election is all about municipal races including local city council seats and bond measures. one of the most controversial races is a measure to support waterfront development in san francisco. the secretary of state will accept voter applications through midnight tonight and you can register online. 8:18. you know, i always expect sal to be able to fix everything in the commute. you have your hands full. what just happened in san jose? >> there's a crash. san jose, even though -- not really affected so much by the b.a.r.t. strike. some people would argue that it is because more people have taken their cars all over the bay area and there's a crash northbound 280 right at highway 880 there and northbound 280 on the right seems to be pretty good. so -- for now, that crash doesn't seem to be having a huge impact on that morning commute. very happy to say that the south bay commute, santa clara valley has been the best of the

commutes we've been looking at this morning. let's take a look at the eastshore freeway, still very busy heading down to the maze. it's backed up into richmond. a lot of slow traffic getting to the bay bridge toll plaza. the slowest traffic in the bay is still in the east bay. you can see 508 as we push in, you also see highway 24 is still very slow. we talked about 80, westbound 580 is actually kind of a surprise. it is backed up to san leandro. it gets slow again. let's get to steve. i saw some tweets coming in from los angeles asking if they woke up in san francisco because there's a lot of thick fog out there. the entire coast, it's amazing to see this much. it will play into a cooler forecast. however, as brandon says in pacifica, we need rain, steve.

let's take a look at how we're looking so far which isn't looking very good. rainfall in san francisco, this will be for october. so far it's been zero. not a drop yet. average is just over an inch of rain. the last october with no rain was back in 1980. no rain in october, does that equal a dry year or a wet year? there were two octobers. 7.42 in 1850. and in 1861 dry, too. but it was 49.27. the odds are against us. we're gonna bet. high pressure is just squashing everything. so there will be sun and subtle changes inland near 80 almost every day this week. 50s and 60s by the coast. there's a little low that will play into the forecast.

welcome back. we are still following a tough commute on the fourth day of the b.a.r.t. strike. live pictures. people lining up there for the ferry. the commute has been slower today than it was on friday, first day of the strike. a lot of people are trying to hop on a ferry to get across the bay and deal with the morning commute affected by the strike. again, the san francisco bay ferry may see as many as 19,000 riders today. we'll keep you posted on what's happening in the morning commute. chris christie is dropping his appeal to block same-sex marriages. the governor's office submitted a formal withdrawal to the state supreme court this morning. just last week, the new jersey supreme court turned down the governor's attempt to block the marriages. on the right there is newly- elected senator cory booker, who performed some of those marriages. and on saturday, jersey city the office was opened up for

friday. the ferries leave every 45 minutes. right now, according to sf bay ferry, things are running smoothly. but no question, sf bay ferry has become a popular alternative. 1900 passengers on sunday. that's actually double than what they typically get on a under is -- on a sunday. and then last friday, day one of the b.a.r.t. strike, ferry officials say they carried more than 7,000 passengers. that's more than double the amount than a typical friday. now, i asked san francisco bay ferry how many passengers they expect. and they say if it's just like july, you could expect to see up to 19,000 passengers they could be carrying. a lot of commuters getting here early. they know about some of the problems from the last b.a.r.t. strike. >> if it goes beyond this week, i think we'll see problems. what i've noticed from the last b.a.r.t. strike more people are real idzing they can -- reage idzing they can -- realizing they can

take the ferry. >> i feel very disrespected by the fact that the two sides are not able to come to an agreement. who knows exactly what's happening. >> reporter: now, sf bay ferry says they have 12 boats running today. two are on loan. now, many commuters say it's actually the afternoon commute that will be tough. not so much the morning commute. many of the commuters say they have to wait in long lines during the afternoon commute. sf bay ferry says if you take the ferry arrive by 4:00, 4:30, the sooner, the better. the lines pick up quickly. as you see a ferry, this lot filled up roughly about two and a half hour ago. overflowed parking is filled.

they are not going anywhere. they are not dependent on a website. here's another thing that the affordable care act does -- in states where governors and legislators have wisely allowed it, the affordable care act provides the opportunity for many americans to get covered under medicaid for the first time. so in oregon, for example, that's helped cut the number of unensured people by 10 -- uninsured people by 10% just in the last three weeks. think about that. that's 56,000 more americans who now have healthcare. offer it or because you are a small business american -- business person and you have to buy it on your own, october 1st was an important date. that's when we opened the new marketplaces where people without health insurance or who can't afford health insurance or who are not part of a group plan can finally start getting affordable coverage. the idea is same pell -- the idea is simple. >> uv been listening to president obama addressing the affordable care act. he's been addressing the computer problems. he says experts are being brought in to help diagnose some technical problems. republicans still ramping up criticism. a spokesman for john boehner says a speech doesn't solve a problem. so far, about 500,000 americans have aplived for -- applied for

insurance. 7million are expected to apply. coverage begins on january 1st. we're tracking the ntsb investigation into a train accident that killed two workers on the b.a.r.t. tracks on saturday. tara moriarty is live in walnut creek with the questions ntsb officials says as they investigate this deadly crash. tara? >> reporter: well, the contra costa times is reporting that the train operator was a b.a.r.t. manager. did he not see the two workers on the tracks? did the two workers on the tracks not see the train coming? these are questioning that the ntsb is delving into right now. you can see there is a memorial set up for the two men struck and killed by the train on saturday. now, crews were out here cleaning up the scene of the accident from 2:00 until 6:00 this morning. the evidence stretches over a third of a mile on the tracks here. people gathered at the walnut creek b.a.r.t. station for a candlelight vigil for larry daniels and chris shepherd. the two workers were struck and

killed by a four-car nonrevenue train while doing a track inspection. one worker was doing the inspection while the other was supposed to be on the lookout. radio transmissions suggest confusion about whether work was going on along the track. this woman worked with shepherd. >> i just know it will be very difficult to go to work, whenever that is, and he's not there. i will definitely miss his presence. >> reporter: according to the san francisco chronicle, b.a.r.t. was training people on how to operate. the ntsb arrived early yesterday to begin the investigation. they will be looking at human error, mechanical issues, that sort of thing. they will be on scene for four to ten days. the investigation will take anywhere from six months to a year. the ntsb will be providing an update at had:00 -- 4:00 this afternoon. so be sure to tune into our 5:00 news to find out what they have to say. tara moriarty, ktvu channel 2

there. alex, there are indications that both sides are making steps to try to settle the dispute. >> there's some movement on both sides. but at this point, no plans for them to return to the bargaining table, although b.a.r.t.'s board of directors has scheduled what they are calling an emergency meeting that will happen at 3:00 this afternoon where they will discuss labor negotiations and the ongoing strike. this is the scene. this is what you will see here at the lake merritt b.a.r.t. station and at b.a.r.t. stations across the system as we head into day four of the burt strike. late last night, the unions made a counteroffer to b.a.r.t. management. the two unions involved here said their proposal would allow for changes to work rules connected to new technology. that's been a sticking point that caused negotiations break break off last week. the unions say they are willing to accept b.a.r.t.'s pay offer. that's a 12% raise over four years. but they are holding firm on

we have continuing coverage of the b.a.r.t. strike now in its fourth day. these are live pictures of the toll plaza. sal says this is still probably the worst spot but it's sternly much beat -- certainly much better than early this morning. this morning, the b.a.r.t. strike snarled traffic across the bay area and left commuters scrambling to find a way to work. meanwhile, b.a.r.t.'s board of directors has called an emergency meeting to discuss the status of negotiations. that will be held this afternoon behind closed doors. truck drivers at theport of oakland are holding a protest. this is new video. the truck drivers say theport is inefficient. it takes too long to get into the ports, pick up the loads and get out. they say the long lines reduce

their earnings. there's a heavy police presence at theport is -- port is morning. we're still following breaking news from las vegas. one person has been shot to death. two others were shot in a triple shooting inside a casino. now, it happened at bally's casino around 6:00 a.m. at an after-hours 23450eu9 club. the two shooting -- nightclub. the two shooting victims were taken to the hospital. police have a suspect in custody. we don't know the condition of the victims. no word what led up to the schoaling. police -- shooting. a proposal for title regulations on gun dealers is scheduled to go before the pleasant hill city council. gun owners will need a permit renewed each year. dealers would have to install an alarm system and surveillance system. employees would have to undergo background chicks. the meeting -- checks.
